Separate statutory responsibility from contracted work and optional assistance when planning a fragrance launch. A factory may perform or coordinate some regulatory tasks if qualified and agreed, but “turnkey” wording does not identify the legal responsible parties or prove a service is included. LAEYO does not currently provide UK Responsible Person (UK RP) services, CPSR safety assessments or complete PIF preparation. Confirm any other manufacturing or documentation support separately for the actual project.
Agree the Product-Specific Deliverables
Agree a product- and destination-specific document inventory. For every item, record who prepares it, who reviews it, who holds it and whether the work is included in the signed scope; do not presume a universal standard package.
Factory or External Work to Confirm
- Safety assessment: For relevant EU/GB cosmetics, the responsible person must ensure the required assessment/report by a qualified assessor. Confirm whether the factory supplies inputs, commissions external work or has qualified in-house resources; no included CPSR service is assumed.
- Fragrance conformity: Request applicable supplier information with exact mixture/use/revision scope. Do not call it IFRA-issued product approval or a substitute for legal requirements.
- Ingredients/allergens: Agree sufficient information for qualified final-formula safety and label review under current destination rules, with controlled access for confidential details; no fixed 26-allergen list applies universally.
- Manufacturing evidence: Review applicable GMP records and any claimed certificate’s holder, site, activity scope and validity. No universal certification or unrestricted batch-record access is assumed.
- Product/package evidence: Confirm the actual study plan, report owner and conditions. No study automatically predicts shelf life or establishes every durability claim.
Documentation You Should Expect to Receive
Use this proposed document index, with scope and access to be confirmed:
The company’s published fragrance documentation-support description lists project-dependent COA, SDS/MSDS for shipping review, carton specifications and label-layout coordination, with ingredient disclosures and IFRA-related statements where applicable. This is a published support scope, not a completed document handover or a promise that every item is included. Agree the product, destination, responsible recipient, access and delivery gate in the actual project scope.
| Document group | Scope and intended user | Delivery gate / access |
|---|---|---|
| Finished-product safety report/records | Qualified assessor and responsible role; product/use/market identified | Before applicable market placement; controlled full access as required |
| Fragrance/ingredient information | Selected mixture and final-formula review; not product approval | Before safety/label freeze; confidentiality arrangements |
| Manufacturing/batch records | Actual site, formula and batch traceability | Before release; agreed authenticated records/summaries |
| Stability/package evidence | Actual configuration, methods, results and limitations | Before affected approval; pending items visible |
| Labels and submissions | Market-specific approved versions and applicable submission record | Before applicable regulatory/launch gate; named holder |
Assign Legal and Contractual Responsibilities
The statutory role depends on the destination and supply arrangement; it is not automatically always the brand or never the factory. A contract can allocate work and costs but cannot simply erase a party’s legal obligations. Identify the actual roles before assigning tasks.
Tasks Whose Owner and Scope Must Be Agreed
- US submissions: Separate facility registration from label-named responsible-person product listing, with exemptions reviewed. Confirm authorized submission assistance in the contract rather than assigning both duties to a US-based brand by default.
- Label/artwork: Name the content provider, qualified destination reviewer, brand approver and printer. Do not assume the factory has no liability or the brand has sole responsibility regardless of law and contract.
- Insurance: Review actual policies, insured parties, exclusions and contractual allocation; no automatic factory or brand coverage is established.
- Voluntary or market-specific certification: Verify the scheme and any legal applicability, certificate holder, scope, validity and logo authorization. Holder and service roles must be confirmed, not inferred.
- Claims evidence: Define the exact claim and assign qualified review and any required study. A factory may assist if included; no automatic refusal, inclusion or clinical-test requirement is assumed.
One Simple Rule to Remember
Name the legal role, then name the deliverable owner. Manufacturing, safety assessment, notification, labeling and transport responsibilities can overlap across organizations. Verify both the governing requirements and the signed service scope.
Common Pitfalls That Delay a Launch
Review the following possible gaps before committing. These are hypothetical risk scenarios, not documented customer incidents or frequency findings:
- Unassigned US roles: A proposed shipment lacks a documented registration/listing applicability decision and named owners. Resolve the gap before the relevant release gate; no automatic Amazon rejection or months-long delay is claimed.
- Unreviewed artwork: Confirm destination-specific content and approvals before printing; record who is responsible for each input and any correction.
- Outdated or mismatched evidence: Review the actual fragrance document’s formula, use, amendment/revision and applicable transition conditions. Do not use an old amendment number or assumed universal expiry period as a shortcut.
How to Build a Smart Compliance Workflow
Plan your compliance process in parallel with fragrance development, not after. Use this sequence as a starting point:
- Identify the actual statutory roles for each destination and supply arrangement; do not treat EU, GB and US “responsible person” definitions as interchangeable.
- Agree the product-specific document inventory, preparation/holding roles, scope, fees, confidentiality and delivery gates.
- Commission a regulatory label review (by an external consultant or your own team) based on the factory’s ingredient data.
- Finalize packaging graphics only after the label review confirms compliance.
- Before the relevant release gate, reconcile product/batch/version records and applicable fragrance-document scope; verify actual updates rather than assuming a fixed certificate-validity period.
Responsibility matrix: law, contract and assistance
| Role / topic | Legal responsibility to verify | Contract includes? | Assistance / evidence owner |
|---|---|---|---|
| EU or GB responsible person | Ensure applicable product compliance, safety/file and notification duties for the actual regime | Named entity and arrangement ___ | Factory/consultant inputs ___ |
| US facility and label-named responsible person | Separate registration, listing and other applicable duties/exemptions | Authorized submission scope ___ | Data provider and reviewer ___ |
| Safety assessor | Relevant qualifications, scientific assessment and signed report scope | In-house/external assessor and fee ___ | Formula/package data owners ___ |
| Manufacturer | Applicable manufacturing, record and supply obligations | Actual development, batch and document deliverables ___ | Subcontractors and limits ___ |
| Brand/distributor/importer | Role-specific duties based on actual supply arrangement | Artwork, claims, commercial approvals ___ | Qualified market reviewer ___ |
| Shipper/DG adviser/forwarder | Actual classification, packing, documentation and other role duties | Transport preparation and service limits ___ | Carrier acceptance/review ___ |
Primary starting points, checked 10 October 2026: EU Cosmetics Regulation, GB statutory guidance, FDA registration/listing and IATA DG classification guidance. The matrix is not a completed legal review or a signed allocation of work.
Reconcile the scope with service claims
Compare each proposed website or quotation phrase such as “full documentation,” “RP service” or “safety assessment included” with an actual named provider and signed deliverable. Mark absent scope as unconfirmed, not included by implication. Request a genuinely de-identified document index showing product/site scope, version, issuer, reviewer, due date and access route. No such service contract or real document index was supplied here.
Frequently Asked Questions
Will the factory register my perfume with the FDA?
Under US MoCRA, facility registration and product listing are distinct obligations. Review the manufacturer/processor facility role and the responsible person identified by the product label, including applicable exemptions. Do not assume the responsible person must be US-based or equate it with a foreign facility’s US agent. A supplier may assist with submissions if authorized and contracted; verify the actual arrangement using FDA’s current registration/listing guidance, checked 10 October 2026.
Can I use the factory’s safety assessment for multiple markets?
Have qualified destination reviewers assess whether the existing evidence and report cover the actual product and local requirements. EU and GB responsibilities and files must be addressed in their own regimes; a separate market does not automatically require every test to be repeated. US safety substantiation is not identical to an EU CPSR requirement. Do not presume universal cross-market acceptance.
The factory says the fragrance is “IFRA compliant.” Is that enough?
No. Review the actual supplier conformity document for the selected fragrance mixture, intended use and version. It does not replace finished-product safety assessment or destination requirements. See IFRA’s explanation, checked 10 October 2026; no document is verified for this project here.
Who provides the batch code and PAO symbol?
Agree batch coding and traceability execution in the manufacturing/packaging scope. Have the responsible qualified reviewer determine the applicable durability information and its evidence; PAO is not universal and is not derived automatically from one stability test. Record the approved label wording and version.
